PART I: TERMS OF SERVICE 

1. End User License Agreement (EULA), Platform Acceptance & App Store Notices 

1.0 Custom EULA — Apple App Store & Google Play Store 

For Apple App Store Users: This Terms of Service constitutes a Custom End User License Agreement ("Custom EULA") between you and Ankita Enterprises LLC (operating as Borough) for the Borough iOS application. This Custom EULA expressly supersedes and replaces Apple's Standard Licensed Application End User License Agreement in its entirety. Apple is not a party to this Custom EULA and has no obligation whatsoever to furnish any maintenance or support services with respect to the Borough app. Apple is not responsible for any product warranties, product claims, consumer protection or privacy compliance, intellectual property infringement, or legal compliance obligations related to the Borough app — all of which are the sole responsibility of Ankita Enterprises LLC. 

You acknowledge that: 

  • Your license to use the Borough iOS app is granted by Ankita Enterprises LLC, not Apple; 

  • Apple and its subsidiaries are third-party beneficiaries of this Custom EULA solely with respect to Apple's right to enforce it against you; and 

  • Apple has no obligation to provide any support, maintenance, or warranty for the Borough app. 

For Google Play Store Users: This Terms of Service constitutes the binding End User License Agreement ("EULA") governing your use of the Borough Android application. Google Play's Developer Distribution Agreement governs the distribution relationship between Borough and Google; it does not govern the relationship between Borough and you as a user. Your rights and obligations as a Borough user are exclusively governed by this Terms of Service and Privacy Policy. By downloading or using the Borough app from Google Play, you agree to be bound by this EULA in addition to Google Play's own Terms of Service. 

1.1 Device Diagnostic Data Consent 

By using the Borough app on any device, you consent to Borough and its service providers collecting technical and diagnostic data from your device — including device type, operating system version, app version, crash logs, performance data, and related diagnostic information ("Diagnostic Data") — for the purposes of: 

  • Providing software updates and product support; 

  • Diagnosing and resolving technical issues; 

  • Improving Platform performance and stability; and 

  • Analyzing aggregate usage patterns to enhance Borough features. 

1.2 Age-Appropriate Experiences — Google Play (Age Signals) 

In compliance with Google Play's Age Signals policy (effective January 1, 2026), Borough uses age signal data provided by the Google Play platform solely to deliver age-appropriate experiences within the Borough app. Borough does not use Age Signals data for any purpose beyond tailoring in-app content and features to be appropriate for the user's age group. Borough's minimum age is 16. 

1.3 Public Benefit Purpose & Government Endorsement Disclaimer 

Borough is a civic technology platform operated for public benefit. 

Borough's mission is to strengthen communities by improving the flow of information between residents, local governments, and civic institutions. The Platform is designed to support civic engagement, neighborhood transparency, and access to local government information as a public good. 

However, Borough is an independent, privately operated platform and is not affiliated with, endorsed by, sponsored by, or acting on behalf of any government entity, municipality, county, special district, or public agency unless that entity has executed a formal Government Partner Agreement with Ankita Enterprises LLC. 

Users acknowledge and agree that: 

  • The presence of Borough in a community does not indicate that any government entity has approved, reviewed, endorsed, or adopted the Platform; 

  • Content published on the Platform does not represent the official position of any government entity unless explicitly published by a verified Government Partner account; 

  • Borough's use of public government meeting recordings for TownHall does not constitute a government partnership or endorsement; 

  • Government logos and seals displayed in TownHall content are used solely for informational attribution; and 

  • Residents should always verify important civic information through official government sources.

1.4 About Borough & Acceptance of Terms 

Borough ("Borough," "we," "us," or "our") is a civic technology platform that connects residents, local governments, elected officials, and community organizations to improve neighborhoods and streamline public services. By accessing or using the Borough platform you agree to be bound by these Terms of Service ("Terms"). 

These Terms apply to all users including Residents, Government Users, Government Partners, Government Representatives (GovReps), Elected Officials, and Businesses. 

If you do not agree to these Terms, do not access or use the Platform. 

2. Eligibility & Account Registration 

2.1 Age Requirements 

The Platform is intended for users aged 16 and older. Users between the ages of 16 and 17 may only use the Platform with verifiable parental or guardian consent and under their supervision. Borough does not knowingly collect personal information from children under 16 in accordance with COPPA and applicable state privacy laws. 

2.2 Resident Account Registration 

Residents must provide accurate, current, and complete information during registration, including a verifiable residential address. You may not: 

  • Create an account using a false identity or another person's information; 

  • Maintain more than one active personal account; or 

  • Use a P.O. Box or non-residential address as your primary address. 

2.3 Government User & Official Accounts 

Borough offers three levels of government access: 

Level 1 — GovRep Account: Any elected official, government employee, or public servant may register using their official government email or manual verification. No institutional approval is required. 

Level 2 — Department Account: An authorized department head may establish a team account without a full Government Partner Agreement. 

Level 3 — Government Partner Account: A full Government Partner Agreement unlocks the complete GovDash platform including verified civic data feeds, real-time service request routing, mass notifications, analytics, and third-party integrations. 

All government users agree to use Borough solely for official purposes, comply with open records laws, and ensure accessibility standards (ADA, Section 508) are met. 

2.4 Account Security 

You are responsible for maintaining the confidentiality of your login credentials. Notify us immediately at legal@boroughusa.org of any unauthorized use of your account. 

3. Beta Program & Pre-Release Access 

3.1 Beta Status 

Borough is currently made available as a beta version of the Platform. The Beta is a pre-release, incomplete version provided for testing and feedback purposes. Borough does not guarantee availability, reliability, or continuity of any Beta feature. The Beta is not intended to be relied upon for emergency services, critical government communications, or time-sensitive civic matters. 

3.2 No Warranty for Beta 

THE BETA IS PROVIDED STRICTLY "AS IS" WITH NO WARRANTIES OF ANY KIND. BOROUGH EXPRESSLY DISCLAIMS ALL WARRANTIES WITH RESPECT TO THE BETA, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. YOUR USE OF THE BETA IS ENTIRELY AT YOUR OWN RISK. 

Borough is an early-stage startup and the Platform is actively being built, improved, and refined. If you encounter any issue, please report it to legal@boroughusa.org or use the in-app "Report a Bug" feature. We are grateful for every user who takes the time to help us build a better civic platform. 

3.3 Beta Data & Stability 

Borough does not guarantee that data created during the Beta — including service requests, posts, Borough Points, and Leaderboard rankings — will be preserved or carried over to future production versions. 

3.4 Government Partner Beta Access 

Government Partners acknowledge that Borough does not guarantee SLA commitments during Beta. Borough may introduce paid Government Partner subscription tiers at any time. Government Partners will receive no less than 60 days' advance written notice before any fees are charged. 

3.5 Beta Feedback 

By participating in the Beta, you grant Borough a perpetual, irrevocable, royalty-free, worldwide license to use any feedback, bug reports, or feature suggestions for any purpose, without any obligation of compensation or attribution to you. 

3.6 Beta Distribution — Apple TestFlight & Google Play Beta 

The Beta may be distributed via Apple TestFlight (builds expire after 90 days) and/or Google Play Beta. Use of these platforms is subject to their respective terms. In the event of conflict, platform terms govern the distribution mechanism; Borough's Terms govern the Platform itself. 

3.7 Beta Confidentiality 

Certain features may be designated as confidential pre-release features. You agree not to publicly disclose, screenshot, record, or distribute information about Confidential Beta Features without Borough's prior written consent. 

3.8 Freemium Access & Content Accuracy 

In communities without an active Government Partner subscription, content is crowd-sourced from resident contributions and publicly available sources. Freemium content is not verified by or connected to official government systems and may not reflect the latest government decisions or service statuses. Residents should verify important civic information through official government sources. 

3.9 App Store Connect & Google Play Console Submission Notice 

Apple App Store Connect requirements: Privacy Nutrition Label; Privacy Policy URL (boroughusa.com/terms-and-privacy); ATT permission request; SDK privacy manifests; Age rating questionnaire (16+); Demo account credentials; Xcode 26 / iOS 26 SDK build; Custom EULA in License Agreement field. 

Google Play Console requirements: News App self-declaration (deadline May 27, 2026); Data Safety section; Privacy Policy URL; Content Rating questionnaire (16+); Beta testing track selected. 

3.10 Transition to General Availability 

Upon GA launch, updated Terms will take effect with reasonable notice. Borough Points and community data will be migrated where technically feasible. Government Partners who entered paid subscriptions during Beta will transition to GA terms with no less than 30 days' written notice. Borough will provide Beta users with no less than 14 days' notice before transitioning to GA. 

4. The Platform & Services 

4.1 Core Features 

  • Neighborhood Feed (Commons) – location-based community discussion board; 

  • TownHall – curated short-form civic journalism clips from public government meetings; 

  • Community Issue Board – resident posting and documentation of non-emergency local issues; 

  • Government Announcements & Alerts – official communications from verified Government Partners; 

  • Borough Points & Leaderboard – civic engagement scoring and community recognition; 

  • Displacement Tracker – resident-sourced tool for documenting businesses and landmarks at risk; 

  • Neighborhood Pulse – anonymous weekly community sentiment surveys; and 

  • Business & Organization Pages – profiles for local businesses and community groups (coming soon). 

4.2 Government Partner Features 

Government Partners accessing GovDash may access service request management, analytics, mass notification tools, public records publishing, and third-party government software integrations. Government Partner access is governed by a separate Government Partner Agreement incorporated into these Terms by reference. 

4.3 Service Modifications 

Borough reserves the right to modify, suspend, or discontinue any aspect of the Platform at any time. Borough will endeavor to provide Government Partners with no less than 30 days' written notice of material changes to features relied upon for public service delivery. 

5. User Conduct & Community Standards 

5.1 General Standards 

All users agree to treat community members with respect, post accurate content, use the Platform only for lawful purposes, and comply with all applicable laws. 

5.2 Prohibited Content & Conduct 

Users may not post content that is defamatory, harassing, threatening, or constitutes hate speech; is false or constitutes deliberate disinformation; infringes third-party intellectual property; contains spam, nudity, graphic violence, or sexually explicit material; impersonates any person or government agency; involves unauthorized data collection; or violates any applicable law including the Computer Fraud and Abuse Act. 

5.3 Government User Standards 

Government Users agree to use Borough solely for official authorized communications, not use Borough for partisan political campaigning, comply with open records and sunshine laws, and ensure accessibility standards compliance. 

5.4 Community Points & Leaderboard 

Users earn Borough Points for civic participation. Your Points total is publicly visible to all verified community members. The top 5 residents by Points are featured on the Community Leaderboard as a standard condition of participation. By creating an account you acknowledge and consent to this public display.

✅ Your Borough Points — earned through civic participation — are visible to all verified members of your neighborhood. 
 
🏆 If you rank in the Top 5 of your neighborhood, your display name and Points total will be featured on the public Community Leaderboard. 
 
🔒 Your private messages and service request details are never publicly visible. 
 
By tapping "Finish" you acknowledge and agree to these community features as described in our Terms of Service and Privacy Policy. 

Any attempt to artificially inflate Points constitutes a violation of these Terms and may result in Points forfeiture, account suspension, or permanent ban. 

5.5 Displacement Tracker 

Displacement Content submitted by residents is owned by the submitting user subject to the license in Section 6.1. Borough may aggregate and publish anonymized Displacement data for civic research and journalism purposes. Borough will never share individually identifiable Displacement Content with third parties without your consent. 

5.6 Neighborhood Pulse 

Neighborhood Pulse responses are anonymous. Borough does not link individual Pulse responses to specific user accounts or identities. Aggregated, anonymized Pulse data may be shared with Government Partners, civic researchers, journalists, and the public. 

5.7 Reporting, Moderation & User Safety Tools 

Reporting Posts — Maximum 2 Taps: 

  • Tap the "..." menu on any post or comment; then 

  • Tap "Report" and select the reason. 

Borough commits to acknowledging all content reports within 24 hours. 

Blocking Users: 

  • Navigate to the user's display name or profile; then 

  • Tap "Block User" from the options menu. 

Blocking is immediate and reversible through Settings > Privacy > Blocked Users. 

Public Profile: User profiles display only your display name and Borough Points total. No personal contact information, home address, or private details are visible publicly. 

Age Rating — 16+: Borough is rated 16+ on both stores. Users under 16 are not permitted. 

For urgent concerns — content involving minors, threats of violence, or public safety — contact legal@boroughusa.org immediately. Borough commits to responding within 24 hours. 

5.8 AI Transparency & Third-Party AI Services

Borough does not share personally identifiable information with third-party AI services for training purposes. Borough will seek explicit user consent before introducing any AI use case involving personal data beyond those disclosed above. 

5.9 Account Deletion — In-App Path 

To delete your account: Open Borough app → Settings → Account → Delete Account → Confirm. Account deletion permanently removes your profile, posts, Borough Points, and personal data within 30 days. You may also request deletion by emailing legal@boroughusa.org

6. Content & Intellectual Property 

6.1 Your Content 

You retain ownership of content you post ("User Content"). By posting, you grant Borough a non-exclusive, royalty-free, worldwide, sublicensable license to use, reproduce, modify, adapt, publish, translate, distribute, and display your User Content in connection with operating and promoting the Platform. This license terminates when you delete your content or account. 

6.2 Government Content 

Government Partners acknowledge that communications published through Borough may constitute public records subject to FOIA and state sunshine laws. Government Partners are solely responsible for records retention compliance. 

6.3 Borough Content 

The Borough Platform, including its software, design, trademarks, logos, and proprietary technology, is owned by Borough or its licensors. Nothing in these Terms grants you a right to use Borough's trademarks or proprietary technology outside of normal Platform use. 

6.4 Feedback 

If you submit feedback or suggestions about Borough, you grant us a perpetual, irrevocable, royalty-free license to use that feedback without any obligation to you. 

7. Service Requests & Government Integration 

7.1 Non-Emergency Services Only 

The issue and service request reporting feature is intended for non-emergency matters only. Borough is not a substitute for emergency services. For emergencies, contact 911. 

7.2 Community Issue Board — Freemium vs. Government Partner 

In Freemium communities, issue posts are visible to the resident community for documentation and discussion purposes. Direct routing to government departments requires an active Government Partner subscription. 

7.3 Government Responsibility for Service Requests 

Borough facilitates submission and routing of service requests but does not guarantee response times, resolution outcomes, or government action. Government Partners are solely responsible for reviewing and responding to service requests. 

7.4 Third-Party Integrations 

Borough may integrate with third-party government platforms (e.g., 311 systems, GIS, CRM). Borough is not responsible for the performance, data practices, or availability of third-party systems. 

8. Privacy 

Your privacy is important to us. Our collection, use, and sharing of your personal information is governed by the Borough Privacy Policy (Part II of this document), which is incorporated into these Terms by reference. 

9. Platform Tiers, Advertising & Business Marketplace 

9.1 Resident Accounts — Current & Future 

Core resident features are currently provided at no charge. Borough reserves the right to introduce optional Borough Premium subscription tiers in a future release. Residents will receive no less than 30 days' advance notice before any previously free features are moved behind a paywall. Core civic features — TownHall, neighborhood feed, issue reporting, and government alerts — will always remain available to all residents at no charge. Premium subscriptions will be processed through Apple In-App Purchase (iOS) or Google Play Billing (Android). Borough Premium is not currently available. 

9.2 Government Partner Fees 

Government Partner access to GovDash is subject to subscription fees set forth in the applicable Government Partner Agreement, billed annually or as otherwise agreed. 

9.3 Borough Pro — Government Representative Subscriptions 

Borough offers Borough Pro — a paid subscription tier for individual government representatives providing enhanced civic intelligence tools, constituent sentiment analytics, and direct engagement features. Borough Pro is available to individual GovRep Account holders without requiring a full Government Partner Agreement. 

9.4 Taxes 

Government Partners and Borough Pro subscribers are responsible for all applicable taxes, except where Borough is legally required to collect and remit such taxes. 

9.5 Advertising — Current Status & Future Intent 

Borough does not currently run advertising on the Platform. Borough intends to introduce a regional advertising program in the future limited to local and regional businesses. When advertising is introduced: 

  • Ads will be geographically targeted based on your verified neighborhood location only — never based on personal browsing history or behavioral profile; 

  • Borough will never sell your personal information to advertisers; 

  • All paid content will be clearly labeled as "Sponsored," "Ad," or "Promoted"; and 

  • Advertising will never appear alongside official government communications from verified Government Partners. 

9.6 Borough for Business — Coming Soon 

Borough intends to launch a Local Business Verification and Marketplace Program in a future release. Government Partner communities may, at the Government Partner's discretion, enable local and regional business features. Any such features are enabled only with explicit Government Partner consent, limited to local businesses, always clearly labeled, and strictly separated from all government content.

9.7 Borough's Permanent Commitments 

Regardless of business model evolution, Borough commits to: 

  • Never sell your personal information to any third party for any purpose; 

  • Never allow advertisers to access your personally identifiable information; 

  • Always clearly label paid and promoted content; and 

  • Always provide 30 days' notice of material changes to advertising or monetization practices. 

10. Civic Journalism, Public Records & Fair Use 

10.1 Borough as a Civic Journalism Platform 

Borough operates as a civic journalism platform. TownHall consists of multiple curated clips — typically 3 to 5 segments of 2 to 3 minutes each — selected from long-form government meeting recordings. The selection, sequencing, and editorial framing of TownHall Clips constitutes original civic journalism and editorial expression by Borough. 

10.2 Fair Use Basis 

Borough's use of Public Proceedings Content is undertaken in good faith as news reporting and civic journalism under the fair use doctrine (17 U.S.C. § 107): 

  • Purpose: Solely for non-commercial civic journalism — the most protected fair use category; 

  • Nature: Government meeting recordings are factual public proceedings with thin copyright protection; 

  • Amount: 3–5 clips of 2–3 minutes from recordings typically 1–4 hours long; and 

  • Market Effect: Borough credits sources, links to full recordings, and drives viewership back to originals. 

10.3 Attribution & Source Credit 

Every TownHall publication will include the originating source name, a link to the full original recording, and the date, meeting type, and jurisdiction. 

10.4 C-SPAN Content 

Congressional Floor Proceedings: Video of U.S. House and Senate chamber debates is in the public domain and may be used without restriction. C-SPAN Produced Content: C-SPAN original programming is subject to copyright and governed by Borough's fair use principles in Section 10.2. 

10.5 YouTube Content & API Compliance 

Borough uses YouTube's official embeddable player and YouTube API Services to display YouTube-hosted government meeting content. Borough does not download, re-host, or redistribute YouTube-hosted video content through its own servers or player. Borough complies with all YouTube API Terms including using only official embed/API mechanisms, not circumventing restrictions, and maintaining required API credentials. Borough self-designates YouTube embedded content appropriately to prevent personalized advertising from being served within the Borough app. 

10.6 Media & Access Media Partnerships 

Borough actively welcomes partnerships with media organizations, PEG access media channels, journalism schools, and civic media nonprofits. If you are interested in exploring a collaboration, please reach out to yuvraj@boroughusa.com

10.7 No Endorsement 

The use of Public Proceedings Content does not imply endorsement of Borough by any PEG channel, government entity, broadcaster, or public official featured in such content. 

10.8 Takedown Requests 

If you are a content owner and believe Borough has used your content beyond fair use, contact legal@boroughusa.org. Borough will review all requests promptly and in good faith. 

10.9 User-Contributed Civic Journalism 

Users publishing civic journalism content represent that their content is factually accurate, they have not misrepresented their identity, and their content does not defame any individual. For Borough's student journalism program, school or parental consent is required for users under 18. 

11. Copyright & DMCA

Your notice must include information required by the Digital Millennium Copyright Act (17 U.S.C. § 512(c)(3)). Borough will process valid takedown notices in accordance with the DMCA. 

12. Disclaimers & Limitation of Liability 

12.1 "As Is" Service 

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. BOROUGH DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. 

12.2 Government Service Delivery 

BOROUGH DOES NOT GUARANTEE THAT SERVICE REQUESTS SUBMITTED THROUGH THE PLATFORM WILL BE ACTED UPON BY ANY GOVERNMENT ENTITY. BOROUGH IS A COMMUNICATION FACILITATOR AND IS NOT RESPONSIBLE FOR GOVERNMENT DECISIONS, ACTIONS, OR INACTIONS. 

12.3 Limitation of Liability 

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BOROUGH'S TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE PLATFORM SHALL NOT EXCEED THE GREATER OF (A) THE FEES YOU PAID TO BOROUGH IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100). BOROUGH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. 

Note for Government Partners: Liability terms are governed by the Government Partner Agreement and may differ from the above. 

12.4 Indemnification 

You agree to indemnify, defend, and hold harmless Borough and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from: (a) your use of the Platform; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any third-party rights. 

13. Bug Reporting, Platform Issues & Startup Disclaimer 

13.1 Borough is a Growing Platform 

Borough is developed and operated by a small, passionate team at Ankita Enterprises LLC. You may occasionally encounter bugs, errors, performance issues, or unexpected behavior. Borough does not warrant that the Platform will be error-free or uninterrupted at any time. 

13.2 How to Report Issues 

  • In-app: Use the "Report a Bug" or "Give Feedback" option in the app menu; 

13.3 Borough's Commitment to Resolution 

Borough commits to acknowledging bug reports as promptly as our team's capacity allows, investigating issues in good faith, and communicating material platform outages via in-app notification or email where feasible. 

13.4 No Liability for Platform Errors 

To the maximum extent permitted by applicable law, Borough is not liable for any loss or damage arising from Platform bugs, errors, downtime, or technical failures. 

13.5 Responsible Disclosure 

If you discover a security vulnerability, report it confidentially to legal@boroughusa.org before any public disclosure. Borough will not pursue legal action against users who report security vulnerabilities in good faith. 

14. Termination 

Residents may delete their account at any time through Settings > Account > Delete Account. Borough may suspend or terminate access at any time for violations of these Terms or for legal or regulatory reasons. Upon termination, your license to use the Platform ends. Sections 6, 10, 11, 12, 13, and 15 survive termination. 

15. Governing Law & Dispute Resolution 

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict of law principles. Disputes between Borough and individual residents will be resolved through binding individual arbitration administered by the AAA under its Consumer Arbitration Rules. YOU WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION. Disputes with Government Partners are resolved as set forth in the applicable Government Partner Agreement. 

16. General Provisions 

  • Entire Agreement: These Terms, together with the Privacy Policy and any applicable Government Partner Agreement, constitute the entire agreement between you and Borough. 

  • Severability: If any provision is found unenforceable, the remaining provisions remain in full force. 

  • No Waiver: Borough's failure to enforce any provision does not waive its right to do so in the future. 

  • Assignment: You may not assign your rights under these Terms without Borough's consent. Borough may assign its rights freely. 

PART II: PRIVACY POLICY 

Plain-Language Summary: Borough collects your information to help connect you with your local government and community. We verify your address to keep your neighborhood feed trustworthy. We do not sell your data. Only your display name and Borough Points are visible to other users — no personal contact information is ever shown publicly. In communities where your local government has not yet partnered with Borough, you may see ads from local and regional businesses in the future — targeted by your neighborhood location only, never by your personal data. 1. Introduction & Scope 

Ankita Enterprises LLC, operating as Borough, is committed to protecting the privacy of all users. This Privacy Policy describes how we collect, use, store, share, and protect your personal information when you use the Platform. 

This Policy applies to the Borough mobile application (iOS and Android), the Borough web platform at www.boroughusa.com, the Borough GovDash administrative portal, and any APIs or integrations that reference this Policy. 

This Policy is intended to comply with the CCPA/CPRA, VCDPA, Colorado Privacy Act, Connecticut Data Privacy Act, and Apple App Store and Google Play Store privacy requirements. 

This Privacy Policy is accessible within the Borough app at all times and is also available at www.boroughusa.com/terms-and-privacy.

2.2 Information Collected Automatically 

  • Device Information: Device type, model, OS version, browser type, unique device identifiers; 

  • Network Information: IP address, mobile carrier, connection type; 

  • Usage Data: Features used, pages viewed, clicks, session duration, crash/diagnostic data; 

  • Precise Location: GPS-based location data, only if you explicitly grant permission. Revocable at any time; 

  • Approximate Location: Location inferred from IP address; and 

  • Log Data: Access times, app activity logs, and error reports. 

2.3 Information from Third Parties 

  • Address Verification Services: Only verification status is retained after verification; raw data is discarded; 

  • Government Data Sources: Jurisdiction boundary data, public records, and GIS data; 

  • Single Sign-On (SSO): We receive only the information you authorize; and 

  • Integration Partners: Data from third-party services connected by Government Partners. 

2.4 Sensitive Information 

Borough may collect precise geolocation (with consent), government-issued ID details (for official verification only), and information about civic participation. Borough does not collect racial or ethnic origin, religious beliefs, health data, biometric data, sexual orientation, or financial account details.

Borough does not sell your personal information. Borough does not use your personal information for behavioral advertising targeting across third-party platforms. In Freemium communities, Borough may in the future display regionally targeted advertisements based solely on your verified community location — not on your browsing history or personal characteristics. 

4. Data Minimization 

Borough is committed to collecting only the minimum personal information necessary to provide the Platform. We do not collect data speculatively or in excess of what is needed for a stated purpose. If you choose not to provide certain information (e.g., precise location), you may still use core Platform features, though some location-dependent features may be unavailable. 

5. How We Share Your Information 

5.1 Within Your Community 

Content you post to neighborhood feeds is visible to other verified members of your neighborhood. Your display name and Borough Points total are the only profile information publicly visible — no personal contact information, home address, or private details are visible on your public profile. 

Displacement Content is visible to verified community members. Aggregated, anonymized Displacement data may be shared with researchers, journalists, and civic organizations. Neighborhood Pulse responses are anonymous and never linked to your identity. 

5.2 With Government Partners 

When you submit a service request, relevant information is shared with the applicable Government Partner solely to facilitate a response. Government Partners may not use resident data for commercial purposes, may not surveil residents, and are contractually bound by Borough's Government Partner Data Processing Agreement. Borough does not allow Government Partners to see a resident's general browsing activity, reading history, or content engagement on the Platform.

All service providers are contractually required to use your data only on Borough's behalf and provide equivalent data protection to this Policy. 

5.4 Apple Sign-In & Platform Requirements 

If you use Apple Sign-In, Borough receives only the information Apple provides pursuant to your authorization. Borough does not use Apple-provided data beyond account authentication and Platform functionality. 

5.5 Legal Requirements & Public Records 

Borough may disclose your information when required by law, valid court order, or legal process. Borough will endeavor to notify you of disclosures where legally permitted. 

5.6 Business Transfers 

If Borough or Ankita Enterprises LLC is acquired or merged, your information may be transferred as part of that transaction. We will provide notice of any such transfer and your rights in connection with it. 

5.7 Aggregated & De-identified Data 

Borough may share aggregated, anonymized data with Government Partners, civic researchers, journalism partners, or the public. Borough never shares individually identifiable data with journalism or media partners. 

6. Location Data 

Borough uses location data to verify residency, deliver neighborhood-specific content and government alerts, and route service requests. Precise GPS location is only accessed with your explicit permission and may be revoked at any time. Borough does not track your location in the background, does not sell location data to advertisers, and does not use location data to build behavioral profiles. 

7. App Tracking Transparency (ATT) — Apple Devices 

Borough will request your permission before accessing your device's advertising identifier (IDFA) or tracking you across other companies' apps or websites. Borough does not engage in cross-app tracking for advertising purposes. You may change your tracking preference at any time in your device's Privacy & Security settings. 

8. AI & Automated Processing 

Borough uses AI for TownHall clip selection (operating on public recordings only, not personal data), Civic Points classification (anonymized engagement data), and content moderation (automated flagging with human review available on request). Borough does not make automated decisions with legal effects on you without human review. Borough does not use your personal account data or private messages to train third-party AI models without your explicit consent.

11. Data Security

  • Vulnerability Management: Documented process for identifying and remediating vulnerabilities; and 

  • Data Breach Response: Notification within 30–72 hours for regulatory notice and as promptly as practicable for user notice.

13. Your Privacy Rights & Choices 

13.1 Universal Rights — All Users 

All Borough users have the right to access, correct, delete, and receive a portable copy of their personal information, opt out of non-essential communications, and withdraw consent at any time without affecting prior processing. 

13.2 California Residents (CCPA/CPRA) 

California residents additionally have the right to know what personal information is collected, opt out of the sale or sharing of personal information (Borough does not sell data), limit use of sensitive personal information, non-discrimination for exercising privacy rights, and receive a response within 45 days. 13.3 Virginia, Colorado, Connecticut & Other State Privacy Laws 

Residents of states with comprehensive consumer privacy laws additionally have the right to opt out of profiling, appeal a denial within 60 days, and receive a response within 45 days (extendable by 45 days with notice). Submit requests to: legal@boroughusa.org 

13.4 European & International Users 

While Borough currently operates primarily in the United States, users in the EEA, UK, or other jurisdictions with data protection laws may have additional rights under GDPR or equivalent law. Contact legal@boroughusa.org for international privacy inquiries. 

13.5 Government Users 

Government Users should direct personal privacy inquiries to their Government Partner's designated privacy officer, as Government Partners operate as independent data controllers for personal information they receive through Borough. 

13.6 How to Submit a Request 

  • In-app: Settings > Privacy > Data Requests 

  • Response time: Within 30 days (45 days for CCPA requests) 

  • Verification: We may ask you to verify your identity before processing your request 

14. Children's Privacy (COPPA Compliance) 

Borough does not knowingly collect personal information from children under 16. The Platform is not directed at children under 16. For users aged 16–17, a parent or guardian must provide verifiable consent before a minor may use the Platform. For Borough's student journalism program, school or parental consent is required for users under 18 who publish content. If you believe Borough has inadvertently collected personal information from a child under 16, contact legal@boroughusa.org immediately and we will delete it promptly. 

15. Third-Party Links, Integrations & SDKs 

This Privacy Policy does not govern third-party data practices. Borough's app may incorporate third-party SDKs. All SDKs are required to provide privacy manifests and signatures in compliance with Apple's SDK privacy requirements. A list of third-party SDKs will be made available at www.boroughusa.com/sdk-list as the Platform develops. For current SDK inquiries, contact legal@boroughusa.org

16. Government Partner Privacy Obligations 

Government Partners acknowledge that they are independent data controllers for personal information received from Borough, are independently responsible for compliance with all applicable government privacy laws, shall maintain appropriate technical and organizational safeguards, shall not use resident data for surveillance or beyond direct government service delivery, and shall notify Borough within 48 hours of becoming aware of any data breach involving Borough-sourced resident data. 

17. Do Not Track 

Borough's web platform currently does not respond to Do Not Track (DNT) signals because there is no agreed-upon standard for how to interpret them. Borough's privacy practices are described in this Policy regardless of DNT signals. 

18. Privacy Nutrition Label (Apple App Store) 

In accordance with Apple App Store requirements, Borough's Privacy Nutrition Label is available on Borough's App Store product page and is kept current with each app update. 

  • Data used to track you: None. Borough does not track users across third-party apps or websites. 

  • Data linked to you: Account information, contact information, location (if granted), user content, displacement content, identifiers, usage data. 

  • Data not linked to you: Crash data, diagnostic logs (anonymized), Neighborhood Pulse responses (anonymous). 

19. Changes to This Policy 

Borough may update this Privacy Policy from time to time. We will notify you of material changes by posting the updated Policy at www.boroughusa.com/terms-and-privacy, sending an in-app notification, and where required by law, sending an email notification. Government Partners will receive at least 30 days' advance written notice of material changes.
